LAW ENFORCEMENT AGENCIES ONLY:

Section 1033 of the National Defense Authorization Act of 1997 authorizes the Department of Defense to transfer excess military property to state and local law enforcement agencies. The eligible agencies in law enforcement activities are government agencies whose primary function is the enforcement of applicable federal, state and local laws, and whose compensated law enforcement officers have powers of arrest and apprehension. Preference is given to counter-drug and counter-terrorism activities.


Requirements:

  • Memorandum of Agreement (MOA): It is an agreement between the State of South Carolina and the Defense Logistics Agency (DLA). Your signature on the last page of the State's 1033 Program Plans, Policies and Procedures document simply means that your office will comply with the rules of the 1033 Program.

  • Law Enforcement Agency Data Sheet: Complete and sign this form. This information will determine the quantity of items your department will be allowed to obtain. The data sheet should be kept current and can be updated when needed.

  • Please mail the signature sheet of the State's 1033 Program Plans, Policies and Procedures document along with the completed data sheet to this office.

Types of Property:

  • Body armor, night vision equipment, APC's, aircraft, first aid supplies, weapons, surveillance equipment, Kevlar helmets, gas masks and filters, vehicles, etc.

Your Cost and Restrictions on Property:

  • There is an administrative fee of 9% (maximum of $2500) of the acquisition cost. There is a one (1) year restricton on all property and a five (5) year restriction on aircraft. Demil equipment (includes weapons, gas masks, helmets, body armor, and night vision devices) must be returned to the nearest Defense Reutilization Marketing Office (DRMO) that is equipped to receive it when its useful life has ended.
